Divorce Papers in Pakistan – Talaq, Khula & Divorce Certificate

If you need divorce papers in Pakistan, the documents and procedure depend on how the marriage is being dissolved. A Muslim marriage may be dissolved through Talaq by the husband, Khula or judicial dissolution by the wife, Talaq-e-Tafweez where the right has been delegated, or an agreed divorce arrangement between the spouses.

What Are Divorce Papers in Pakistan?

"Divorce papers" is a general term used for the legal documents connected with the dissolution and official recording of a marriage. Depending on the circumstances, these may include a Divorce Deed, Talaq Notice, legal notice, Khula or dissolution decree, Union Council documents, and Divorce Certificate.

The exact documents required depend on whether the divorce is initiated by the husband, sought by the wife through Khula or judicial dissolution, exercised under a delegated right of divorce, or arranged by mutual agreement.

Divorce Procedure in Pakistan

The procedure is different for Talaq, Khula and other forms of dissolution. It is therefore important to identify the correct legal route before preparing or signing divorce documents.

1. Divorce by Husband – Talaq

Where a husband pronounces Talaq, the divorce process includes giving written notice of the Talaq to the Chairman of the concerned Union Council in accordance with Section 7 of the Muslim Family Laws Ordinance, 1961.

The notice is followed by the statutory reconciliation process. An Arbitration Council is constituted for the purpose of attempting reconciliation between the parties. Subject to the applicable law, the Talaq becomes effective after the prescribed statutory period, generally 90 days from delivery of the notice to the Chairman, unless the law provides otherwise, including in relation to pregnancy.

After completion of the applicable Union Council process, the relevant divorce documentation can be obtained.

2. Divorce by Wife – Khula

A wife may seek dissolution of marriage through Khula before the Family Court. Khula is a distinct legal remedy and should not be confused with Talaq-e-Tafweez, which concerns a delegated right of divorce recorded in the marriage contract.

Where a wife seeks Khula, the Family Court process may involve filing a suit, service of notice upon the husband, reconciliation efforts and, where reconciliation fails and the legal requirements are satisfied, passing of a decree for dissolution of marriage.

After the court process, further documentation and registration requirements may apply before the divorce is officially recorded and the relevant certificate is obtained.

3. Talaq-e-Tafweez – Delegated Right of Divorce

In some marriages, the Nikahnama may contain a delegation of the right of divorce to the wife. This is known as Talaq-e-Tafweez. Whether this right exists and how it may be exercised depends upon the terms recorded in the Nikahnama and the applicable law and procedure.

A copy of the Nikahnama should therefore be carefully examined before deciding which divorce procedure applies.

4. Mutual Divorce

Where both spouses agree to dissolve the marriage, the parties may enter into an appropriate written agreement or divorce deed setting out the agreed terms. Depending on the circumstances, the applicable legal and Union Council requirements must still be followed.

Issues such as dower, maintenance, child custody, child maintenance and other agreed matters should be clearly documented where legally appropriate.

Union Council Divorce Procedure in Pakistan

For Talaq proceedings governed by Section 7 of the Muslim Family Laws Ordinance, 1961, the husband is required to give written notice of the pronouncement of Talaq to the Chairman of the concerned Union Council and supply a copy to the wife.

The Chairman constitutes an Arbitration Council to attempt reconciliation between the parties. The statutory period and applicable procedure must be completed before the Talaq becomes legally effective under the relevant law.

The correct Union Council depends on the circumstances of the marriage and the parties' residence. Therefore, jurisdiction should be confirmed before filing the notice.

Documents Required for Divorce Papers in Pakistan

The documents required vary according to the type of divorce. Commonly requested documents may include:

  • Copy of the Nikah Nama or marriage registration document.
  • CNIC/NICOP or passport copies of the parties, as applicable.

Depending on the circumstances, an overseas client may be able to authorize a lawyer or representative in Pakistan through an appropriately prepared and executed Power of Attorney. The requirements for execution, attestation, verification and use of such documents can vary depending on the country of residence and the nature of the matter.

Divorce Certificate in Pakistan

A Divorce Certificate is an important official document used as evidence that the dissolution of marriage has been recorded following completion of the applicable legal process.

The procedure for obtaining the certificate depends on the manner in which the marriage was dissolved. For this reason, a Divorce Certificate should not be treated as a substitute for the underlying Talaq, Khula or court procedure.
