Talaq Procedure and the 90-Day Period
Section 7 of the Muslim Family Laws Ordinance, 1961 provides that a husband who pronounces Talaq must, as soon as possible, give written notice of the Talaq to the Chairman and supply a copy to the wife. The Chairman is required to constitute an Arbitration Council within thirty days of receiving the notice for the purpose of attempting reconciliation.
Under Section 7(3), Talaq does not become effective until ninety days have expired from the date the notice is delivered to the Chairman, unless it is revoked earlier. If the wife is pregnant when Talaq is pronounced, Section 7(5) provides that the Talaq does not become effective until the later of the applicable ninety-day period or the end of the pregnancy.
Accordingly, the ninety-day period should not simply be described as starting on the date of the verbal pronouncement. The statutory period is linked to delivery of the notice to the Chairman.
What Happens After the 90-Day Period?
Where the statutory requirements have been fulfilled and reconciliation does not result in revocation of the Talaq, the divorce becomes effective according to Section 7. The relevant authority can then complete the registration and certification process required for the official divorce documentation.
Khula and Divorce Certificate
Khula is a separate legal route from Talaq by the husband. A wife may seek dissolution of marriage through the Family Court.
